Representative, Senior Land
- Negotiate with landowners, tenants, and attorneys, to acquire rights of way and easements, leases, real property in fee, permits and other real property transactions for pipelines, valves, appurtenances, cathodic protection facilities, and other facilities, as needed.
- Investigate landowner and tenant complaints and damage claims and negotiate damage settlements. Issue checks for the payments of Issue checks for the payments of rights of way and ompensation for damages caused by the construction, operation, maintenance, relocation, removal, etc. of pipelines and other facilities, and for tracts of land leased, or optioned for purchase.
- Research and locate easement agreements on existing assets and provide information related to existing rights to Operations, Engineering, etc. and/or landowners.
- Identify and secure permits from private, local, state, and federal authorities for occupancy of various land types, including roads, highways, railroads, rivers and streams.
- Secure permission for surveys for operation and maintenance activities. Locate and supervise surveyors, if necessary.
- Conduct title searches (public records, title opinions/policy, and other legal documents) to determine current ownership of real property and the location of landowners. Plot property descriptions of effected lands on pipeline survey maps.
- Draft and prepare correspondence, letter agreements, and legal documents for use in dealing with governmental agencies, landowners, tenants, and developers, including Amendatory Easements and Partial Release Agreements and notifications. Review, recommend changes to, negotiate, and circulate these agreements for approval from Land Mgmt., Legal, Operations and Commercial, etc., where necessary.
- Respond to landowners and public agency inquiries regarding land rights and protect these rights from misinterpretation.
- Be knowledgeable of areas of potential encroachments and respond to impending and actual encroachment notices. Negotiate conclusions favorable to Company interests. Assist in contacting third party contractors and local, state and federal authorities in matters pertaining to encroachments.
- Represent Company at public hearings such as Zoning and Planning Boards and County Commissioners meetings. Present testimony as needed in the legal court system when exercise of eminent domain rights becomes necessary or when an injunction or temporary restraining order is issued.
- Gather data necessary to establish crop and timber values, yields and production records. Assess, negotiate and issue checks for damage settlements resulting from Operations and Engineering activities in accordance with the terms of the controlling right of way easement and/or permit. Coordinate right of way clearing and reclamation activities, including making landowner contacts and negotiating damage settlements.
- Research, analyze, and evaluate historical ownership chain of Company assets and systems. Prepare title curative documents as needed to cure title defects.
- Assist with due diligence reviews and evaluation related to potential asset acquisitions or divestitures.
- Be aware of the importance of good public relations and representing the appropriate Company image in all private and public dealings.
- Be able to work with little to no supervision on a daily basis.
- Travel to field as needed to represent company with landowners or other 3rd parties.
- A Bachelor's degree in business administration, Law, Communications, or Public Relations emphasis is preferred.
- A minimum of five years' experience in the Land and Right of Way profession; and/or equivalent experience in dealing with real estate, landowners, local, state and federal agencies, and agricultural and livestock management is required.
- Must have strong communication, organization and leadership skills, interface and deal effectively with all levels of personnel and people, maintain effective work relations, and have the ability to handle sensitive information and negotiations.
- Must have a good understanding of real property law and principles.
- Must have strong ability to work effectively in a fast paced work environment, be flexible and able to adapt to changes in work activities, process work rapidly, set priorities, work under pressure and follow through with assigned tasks.
- Knowledgeable of Microsoft Office products: Word, Excel, Outlook, Google Earth or other GIS software (ArcGIS, etc.).
- Member of the International Right of Way Association (IRWA) and/or is a Licensed Real Estate Agent.
- Must have or be willing to obtain a Texas Notary Commission.
